    Default Text of Healthcare Reform bill

    For anyone interested, here is a link to the full text of the healthcare reform bill currently being debated in Washington.

    It's some pretty brain squeezing reading. I'm sure between all of us we should be able to be able to pick it apart pretty well and debate it.

    Ok, here's a piece to start the ball rolling. Page 16.

    (1) LIMITATION ON NEW ENROLLMENT.—
    11 (A) IN GENERAL.—Except as provided in
    12 this paragraph, the individual health insurance
    13 issuer offering such coverage does not enroll
    14 any individual in such coverage if the first ef-
    fective date of coverage is on or after the first
    day of Y1.
    In other words, you get to keep your current coverage. However, if you change jobs and have to enroll in a new plan the new HMO is not allowed to accept you.

    Here's another piece that seems a bit sticky. Pg 319.


    The hospital does not offer a
    physician owner or investor the oppor-
    tunity to purchase or lease any property
    under the control of the hospital or any
    other owner or investor in the hospital on
    more favorable terms than the terms of-
    fered to a person that is not a physician
    owner or investor.
    First of all, what does this have to do with providing quality healthcare? 2nd. Does this mean that if a doctor has stock in the hospital he is not allowed to lease office space in any of their properties? That would certainly affect a lot of docs currently working out of that building off the parking garage at Parkview.

    Here's one for for anyone aspiring to be a nurse. Pg 893-895

    ‘‘(A) to train advanced education nurses
    17 who will practice in health professional shortage
    18 areas designated under section 332; or
    19 ‘‘(B) to increase diversity among advanced
    20 education nurses.’’.
    (e) LOAN REPAYMENT.—Section 846 (42 U.S.C.
    20 297n) is amended—
    21 (1) in subsection (a), by amending paragraph
    22 (3) to read as follows:
    23 ‘‘(3) who enters into an agreement with the
    24 Secretary to serve for a period of not less than 2
    25 years—‘‘(A) as a nurse at a health care facility
    2 with a critical shortage of nurses; or
    3 ‘‘(B) as a faculty member at an accredited
    4 school of nursing;’’;
    That means that anyone who uses a federal loan to go to school (who doesn't anymore?) to be a nurse will have to work wherever in the country the government tells them to for the next 2 years. Don't want to work in Alabama? Tough. Find another career.

    ‘‘(C) PROHIBITION ON EXPANSION OF FA22
    CILITY CAPACITY.—Except as provided in para-
    graph (2), the number of operating rooms, pro-
    cedure rooms, or beds of the hospital at any
    time on or after the date of the enactment of this subsection are no greater than the number of operating rooms, procedure rooms, or beds,
    respectively, as of such date
    This means that however a rural hospital is built, that's how it has to stay. They can't build any new wings, no new operating rooms, no higher capacity. They are not allowed to improve their facilities to better serve their patients.

    Pg 22 of the HC Bill MANDATES the Govt will audit books of ALL EMPLOYERS THAT SELF-INSURE!!

    Pg 30 Sec 123 of HC bill - THERE WILL BE A GOVT COMMITTEE that decides what treatments/benefits you get

    Pg 354 Sec 1177 - Govt WILL RESTRICT ENROLLMENT of Special needs people

    Pg 42 of HC Bill - The Health Choices Commissioner will choose your HC Benefits for you.

    PG 50 Section 152 in HC bill - HC WILL BE PROVIDED TO ALL NON-US CITIZENS, illegal or otherwise

    Pg 170 Lines 1-3 HC Bill- ALL NON-RESIDENT ALIENS will be exempt from individual taxes.

    (Resident Americans will pay)

    Pg 58 HC Bill - Govt will have real-time access to individuals finances & a National ID Healthcard will be issued

    Pg 59 HC Bill lines 21-24 Govt will have direct access to your bank accounts for electronic funds transfer, no choice

    Pg 72 Lines 8-14 Govt is creating an HC EXCHANGE to bring private HC plans under Govt control.

    PG 84 Sec 203 HC bill - Govt mandates ALL benefit pkgs for private HC plans in the Exchange

    PG 85 Line 7 HC Bill - Specs. for of Benefit Levels for Plans

    Pg 95 HC Bill Lines 8-18 The Govt will use groups i.e., ACORN & Americorps to sign up individuals for Govt HC plan

    pg 124 lines 24-25 HC No company can sue Government on price fixing. No "judicial review" against Government Monopoly

    pg 127 Lines 1-16 HC Bill -DOCTORS/ AMA - The Govt will tell you what your salary will be.

    Pg 145 Line 15-17 An Employers MUST auto enroll employees into public option plan. NO CHOICE

    Pg 126 Lines 22-25 Employers MUST pay for HC for part time employees AND their families.

    Pg 149 Lines 16-24 ANY Employer with payroll 400k & above, who does not provide public option, pays 8% tax on all payroll

    pg 150 Lines 9-13 Businesses with payroll btw 251k & 400k who doesn't provide public option pays 2-6% tax on all payroll

    Pg 167 Lines 18-23 ANY individual who doesn't have acceptable HC according to the Govt will be taxed 2.5% of income

    Pg 195 HC Bill -officers & employees of HC Admin (GOVT) will have access to ALL Americans finances/personal records

    PG 203 Line 14-15 HC - "The tax imposed under this section shall not be treated as tax"

    READ THE FOLLOWING LINES SLOWLY....

    PG 427 Lines 15-24 Govt mandates program for orders for end of life. The Govt has a say in how your life ends

    Pg 429 Lines 1-9 An "adv. care planning consult" will be used frequently as patients health deteriorates

    PG 429 Lines 10-12 "adv. care consultation" may include an ORDER FOR END OFLIFE plans. AN "ORDER" from GOV

    Pg 429 Lines 13-25 - The govt will specify which Doctors can write an end of life order.

    PG 430 Lines 11-15 The Govt will decide what level of treatment you will have at end of life.

    I've been telling you all - Obama is a black Hitler...

    People need to flood their lawmakers with "JUST SAY NO" to this bill!!!!!

    Plus it's unconstitutional anyway. Especially the part about not being able to sue the government - that is in direct violation of the US Constitution and people's rights to address grievances with the government.

    Large you should post that at the Gazette, there's an article about Obama's plan there - something about Obama's plan being on the ropes...

    Large, can you explain this one to me? I guess I don't understand the legaleze in that line.


    SEC. 152. PROHIBITING DISCRIMINATION IN HEALTH CARE.
    (a) IN GENERAL.—Except as otherwise explicitly permitted by this Act and by subsequent regulations consistent with this Act, all health care and related services
    (including insurance coverage and public health activities)
    covered by this Act shall be provided without regard to
    personal characteristics extraneous to the provision of
    high quality health care or related services.

    NONRESIDENT ALIENS.—Subsection (a)
    shall not apply to any individual who is a nonresident alien.
    Also, where do you find the subsection (a) mentioned here to say that they won't pay taxes?

    PG 430 Lines 11-15 The Govt will decide what level of treatment you will have at end of life.
    You didn't go far enough with that statement. It actually says that the government will decide what level of treatment you WILL NOT get.

    The level of treatment indicated under subparagraph (A)(ii) may range from an indication for full treatment to an indication to limit some or all or specified
    interventions. Such indicated levels of treatment may include indications respecting, among other items—
    ‘‘(i) the intensity of medical intervention if the
    patient is pulse less, apneic, or has serious cardiac
    or pulmonary problems;
    In other words, if you have a heart condition you probably won't get treatment for it, and almost certainly won't be getting a transplant.

    Chuckie, I'm still sorting all that out myself . . I got that list from an old friend who is a retired surgeon . . He emailed it to me, and after a basic perusal, I posted it . .

    He, since, has also stated that in many cases, such as the contradiction about illegal aliens, there are conflicts . . and if the bill is made into law, as is, it'll take several years of court cases to rectify all of those same conflicts.

    His opinion is that the entire bill is flawed and is not only not needed, but will totally screw up health care in this country for at least fifty years while the courts and lawmakers modify it to work . . if it works at all even then . .

    I might also comment . . Obama has said that the AMA, ASA, and several other Medical or doctor's organizations have endorsed "Health Care REFORM" . . Not necessarily HIS Health Care PLAN . . as well as, in the case of both the AMA and the American Surgeons Association, those organizations only represent about 15-20% of the doctors in this country . . and most often, Interns . .

    As I said in another Post, last week I had surgery, and NO ONE in the hospital had a kind word for Obama or "Obamacare" . . Suppose they know more than we do?
